For decades\, Indigenous people have b een calling for the right to stop their art\, songs\, stories and knowled ge from being appropriated. Existing intellectual property laws have been inadequate in safeguarding this Indigenous Cultural and Intellectual Pro perty.
In May 2024\, the World Intellectual Property Organisation (WIPO) Treaty on Genetic Resources\, Intellectual Property and Tradition al Knowledge was finalised. Will this Treaty shape the future internation al framework for recognising and protecting traditional knowledge and tra ditional cultural expression?
Australia is also developing a law of Indigenous Cultural and Intellectual Property\, which will address fak e arts and appropriation of knowledge and cultural expression.
In this presentation\, Dr Terri Janke will share her vision for future lega l protection of Indigenous Cultural and Intellectual Property.
The Francis Gurry L ecture on Intellectual Property was established by the Melbourne Law Scho ol\, in conjunction with the Institute of Patent and Trade Mark Attorneys of Australia\, in 2009. The Lecture is named in honour of the Law School 's distinguished alumnus\, Dr Francis Gurry\, Director General of the Wor ld Intellectual Property Organization (2008-2020).
